SECTION 33-11-45

   § 33-11-45  Claim barred by failure toprove or prosecute. – If a claimant shall not request probate court determination of its disallowedclaim or bring civil action on its disallowed claim within the deadlines ofthis chapter, any action on said claim against the personal representative andestate of the decedent shall be forever barred. Affidavit of the personalrepresentative or certificate of the district or superior court clerk that nocivil action was brought by the claimant in the relevant time period shall besufficient to establish failure to timely prosecute.
