SECTION 33-17-25

   § 33-17-25  Suit for benefit of allinterested in estate. – A suit may also be brought on a bond for the benefit of all concerned in theestate at the instance of any party interested, who shall give surety for coststo the defendant on the writ, and satisfactory bond to the probate courtsecuring the court against expenses and costs; in which case, indorsement thatthe suit is brought for the benefit of all interested in the estate shall bemade upon the writ.
