SECTION 33-17-28

   § 33-17-28  Administration of amountrecovered in suit for failure to inventory or account. – In case of a recovery, the amount so recovered shall be deemed to be theproperty of the testator or intestate, and, after paying therefrom all expensesof recovery, shall be administered by a new administrator to be appointed forthat purpose.
