§ 33-21.1-26 - Action to establish claim.

SECTION 33-21.1-26

   § 33-21.1-26  Action to establish claim.– A person aggrieved by a decision of the administrator, or whose claim has notbeen acted upon within ninety (90) days after its filing, may bring an actionto establish the claim in the superior court, naming the administrator as adefendant. The action must be brought within ninety (90) days after thedecision of the administrator or within one hundred and eighty (180) days afterthe filing of the claim if he or she has failed to act on it. The action shallbe tried de novo without a jury.
