SECTION 34-11-3

   § 34-11-3  Creation of co-tenancies by deed– Conveyances between husband and wife. – (a) In deeds hereafter made, lands, tenements and hereditaments, or a thing inaction, may be conveyed by a person to him or herself jointly with anotherperson by the like means by which it might be conveyed by him or her to anotherperson; and may in like manner, be conveyed by a husband to his wife and by awife to her husband, alone or jointly with another person; and may also in likemanner, be conveyed by a husband to himself and to his wife and by a wife toherself and to her husband as tenants by the entirety; and may also in likemanner be conveyed by co-tenants to any one of the co-tenants.

   (b) A husband and his wife or any two (2) or more persons mayconvey real estate or interests therein to themselves as co-tenants under anytenancy allowable between them by law. This subsection shall not be construedso as to invalidate any deed of real estate or interest therein heretoforegiven by a husband and his wife or any two (2) or more persons to themselves asco-tenants under any tenancy allowable between them by law.
