§ 34-11-36 - Defective acknowledgments.

SECTION 34-11-36

   § 34-11-36  Defective acknowledgments.– Any acknowledgment of or upon any instrument used in conveying, directly orindirectly, any interest in real estate in this state, including power ofattorney, where the instrument has been on record for a period of ten (10)years, shall be construed to be a valid acknowledgment in accordance with therequirements of chapter 12 of this title; provided, nevertheless, that if,within the period of ten (10) years, a proceeding is commenced in superiorcourt relative to the validity of the acknowledgment, and a notice of lispendens is duly recorded and indexed with the appropriate records of landevidence, the instrument shall be subject to the further order of the courtinvolved in any such proceeding.
