SECTION 34-14-4

   § 34-14-4  Failure of person joined asplaintiff to appear. – If any person named as plaintiff without his or her consent neglects to appear,after being duly notified in such manner as the court shall direct, his or hername shall be stricken from the writ and pleadings, and the other persons namedas plaintiffs may prosecute the action to final judgment and execution in theirown names and for their own use.
