SECTION 34-4-8

   § 34-4-8  Notice of petition for sale– Representation of minors and parties not ascertained. – Notice of a petition for sale shall be given in such manner as the court mayorder to all persons who are, or may become, interested in the real estate towhich the petition relates, and to all persons whose issue not in being maybecome interested in the property. The court shall in every case appoint asuitable person to appear and act on the petition as the next friend of allminors, persons not ascertained, and persons not in being, who are, or maybecome, interested in the real estate. The cost of the appearance and theservices of the next friend, including the compensation of his or her counsel,to be determined by the court, shall be paid, as the court may order, eitherout of the proceeds of the sale or by the petitioner, and in the latter caseexecution for the compensation may issue in the name of the next friend.
