SECTION 35-3-7.1

   § 35-3-7.1  Biennial capital developmentprogram. – (a) Biennially, for presentation to the voters at the next general election, acomprehensive plan detailing the capital goods and services required in theupcoming two (2) year period will be presented.

   (b) The plan shall also include consideration of the currentcapital indebtedness and the proposed capital requirements for all independentauthorities created under and by the laws of this state.

   (c) All capital referenda will be presented to the voters ata general election, except, upon a finding of compelling need for the publichealth, safety, or welfare, the general assembly may present the capitalprogram at a time other than the general election.
