SECTION 39-11-8

   § 39-11-8  Issuance of certificate –Proof required. – The administrator may issue a certificate granting the application in whole orin part and may impose such terms and conditions as he or she may deem properin the public interest. The applicant for the certificate shall be entitled tothe certificate only upon showing by competent evidence that the publicconvenience and necessity requires the proposed service or operation and thatthe applicant is fit, willing, and able to provide the service proposed andfound to be required.
