§ 39-12-36 - Unlawful operations – Penalty.

SECTION 39-12-36

   § 39-12-36  Unlawful operations –Penalty. – (a) Any person, subject to the provisions of this chapter, who shall knowinglyor willfully cause to be done any act prohibited by this chapter, or who shallbe guilty of any violation of this chapter for which no penalty is otherwiseprovided, shall be guilty of a misdemeanor; and shall, upon conviction thereof,be subject to a fine of not to exceed one thousand dollars ($1,000) orimprisonment for a term not exceeding one year, or both for each offense.

   (b) The administrator may in his or her discretion in lieu ofseeking criminal sanctions, impose upon its regulated common or contractcarriers an administrative civil penalty (fine) in lieu of revoking orsuspending the carrier's operating authority as conferred under this chapter.The fine shall not exceed one thousand dollars ($1,000) per each violation ofthe sections contained in this chapter or the division's rules and regulationspromulgated thereunder.
