   § 39-3-9  Testing of measuring devices.– The division shall provide for the examination and testing of any and allappliances used for measuring any product or service of any public utility. Anyconsumer or user may have any appliances tested upon payment of the fees fixedby the division. The division shall declare and establish reasonable fees to bepaid for the testing of appliances on the request of the consumers or users,the fee to be paid by the consumer or user at the time of his or her request,but to be paid by the public utility and repaid to the consumer or user if theappliances be found defective or incorrect or to the disadvantage of theconsumer or user. A meter shall be deemed correct for the purpose of thissection if it appears from the examination or test that it does not vary morethan two percent (2%) from the standard approved by the division.
