SECTION 39-4-24

   § 39-4-24  Actions for penalties andforfeitures. – An action to recover a penalty or forfeiture under this chapter shall bebrought in any court of competent jurisdiction in this state in the name of thestate, and shall be commenced and prosecuted to final judgment by theadministrator. All money recovered in any action, together with the coststhereof, shall be paid into the state treasury. Any action may be discontinuedor compromised on application of the administrator upon such terms as the courtshall approve and order.
