SECTION 39-6-3

   § 39-6-3  Action to abate unlicensed road.– In addition to the remedy by indictment for the nuisance the attorney generalshall, for the purpose of abating any nuisance, file on the part of the state,in the superior court, a civil action or information against any person orcorporation who shall build any railroad or portion of a railroad, and thecourt shall take jurisdiction of, hear, determine, decree, and proceed thereonas in cases of private nuisance.
