SECTION 39-8-1

   § 39-8-1  Surfacing of highways crossed atgrade. – Every railroad corporation whose roadbed crosses the public highway at gradeshall cause the crossing to be covered with suitable material for highwaytravel so that the surface of the highway at the crossing shall not at any timebe lower than three-fourths (3/4) of one inch (1") below the tops of the railsat the crossing; and every railroad which shall neglect or refuse to complywith the provisions of this section, after being notified by the city or towncouncil of the city or town wherein the crossing is located, shall be fined notexceeding one hundred dollars ($100).
