SECTION 39-8-18

   § 39-8-18  Fences along right of way.– Every railroad corporation or company shall erect and thereafter maintain afence or fences along the boundary lines of its rights of way which areactually used for rail transportation of any kind whenever the public utilitiescommission shall determine it to be necessary for the public safety andwelfare. The commissioner may prescribe the height, length, materials, anddesign of the fence or fences.
