   § 4-13-34  Correction of defects inprosecutions. – Any defect in any action, complaint and warrant, indictment or other proceedingcommenced and prosecuted under this chapter, either of form or substance, maybe amended by the court before which the action, complaint and warrant orindictment is originally brought or may be pending.
