SECTION 40.1-23-10
§ 40.1-23-10 Construction – Effect onother laws. – (a) It is specifically intended that the provisions of this chapter shall beavailable for the benefit of all persons with developmental disabilities whoare now resident at state facilities, or on placement from such facilities, orwho reside within the state.
(b) This chapter shall not repeal, amend, or modify any lawrelating to intestate succession or relating to guardians of the person or ofthe estate of an individual. In the event of the appointment of the guardian ofthe person, the rights of the guardian will supersede and abrogate the rightsof the parental successor of the person for whom a guardian of the person hasbeen appointed, for so long as the appointment of the guardian of the person iseffective.
