SECTION 40.1-23-8

   § 40.1-23-8  Termination of designation orappointment. – (a) Any designation or appointment of a parental successor is subject torevocation at any time, in the first instance by the person who made thedecision, and in the case of appointment by will or formal appointment, by thecourt in which the will was probated or the formal appointment was made. Aperson or organization named as parental successor may renounce or resign atany time.

   (b) No revocation, renunciation, resignation, death, or stateof incapacity will be binding on the director of the department of mentalhealth, retardation, and hospitals until he or she has been notified in writinghereof.
