   § 40-13.2-3  Employment background checks.– Any person seeking to operate a facility which is, or is required to be,licensed or registered with the department will submit an affidavit to thedepartment providing information relating to individual employment history asshall be required by rule promulgated by the director. Any person operating afacility which is, or is required to be licensed or registered with thedepartment shall require all persons seeking employment, if that employmentinvolves supervisory or disciplinary power over a child or children or involvesroutine contact with a child or children without the presence of otheremployees, to execute a similar affidavit prior to employment and will maintainthe affidavit on file subject to inspection by the director. Failure to requirethe affidavit or failure to maintain the affidavit on file will be prima faciegrounds to revoke the license or registration of the operator of the facility.
