SECTION 42-17.1-1

   § 42-17.1-1  Department established. –There is hereby established within the executive branch of the state governmenta department of environmental management. The head of the department shall bethe director of environmental management, who shall be in the unclassifiedservice and who shall be appointed by the governor, with the advice and consentof the senate, and shall serve at the pleasure of the governor.
