SECTION 42-17.10-2

   § 42-17.10-2  Form of summons. – (a) The form of the summons and the complaint authorized by this section shallbe used for all environmental civil violations specified in § 42-17.10-1.The summons and complaint to be issued to an alleged offender shall containsuch information, and be in such form, as may be required by the rules andprocedures promulgated by the chief judge of the district court for the traffictribunal. Every summons shall provide notice of: (i) the charge or chargesagainst the individual; and (ii) a date to appear in the traffic tribunal andanswer the charges against him or her.

   (b) The summons may be the same as the summons provided forin § 31-27-12. The chief of law enforcement of the department ofenvironmental management, the chief executive officer of any other policedepartment citing persons for environmental civil violations in accordance with§ 42-17.10-1, peace officers and other individuals authorized to enforcecivil violations as stipulated in § 42-17.10-1 shall prepare or cause tobe prepared any records and reports that may be prescribed by the rules of thetraffic tribunal.
