SECTION 42-20-13

   § 42-20-13  Right of appeal – Power torecover penalties. – The right of appeal to a court of competent jurisdiction as provided by lawshall not be abridged or impaired by the passage of this title. The right ofthe head of any department or any subdivision thereof to prosecute for anyoffense to recover a penalty or forfeiture as provided by law for anydepartment, division, board, commission, or officer shall henceforth be vestedin the head of the department as set forth in this title.
