SECTION 42-29-13

   § 42-29-13  Action on deputy's bond. –Any person injured by the breach of the bond of any deputy sheriff may, afterrecovering judgment against the deputy sheriff, his or her executors oradministrators, for the default, misfeasance, or nonfeasance of the deputysheriff, cause a suit to be instituted upon the bond of the deputy at his orher own cost, in the name of the sheriff, to his or her own use.
