SECTION 42-29-17

   § 42-29-17  Judgment for costs againstdefendant. – If the defendant shall recover judgment for costs, execution shall issuetherefor against the person for whose use the suit is brought, and not againstthe general treasurer or sheriff, and the surety for costs of such person, ifany there be, shall be liable for such costs as such sureties are in othercases.
