SECTION 42-29-26

   § 42-29-26  Failure to serve process.– Every sheriff or deputy sheriff who shall neglect or refuse to serve anyprocess issuing from lawful authority, directed to him or her to serve andexecute (having in all civil causes, paid or tendered unto him or her his orher legal fees, if he or she demand the same, for serving and executing suchprocess), shall be liable to the party aggrieved for such damages as he or shemay have sustained by such neglect or refusal.
