SECTION 42-72.9-8

   § 42-72.9-8  Penalties. – (a) Any covered facility that does not comply with the provisions of thischapter is subject to licensing action, including, but not limited to, licenserevocation, by the agency or department of state government that hasjurisdiction or supervisory control over the covered facility.

   (b) Any service provider who willfully and intentionallyviolates the provisions of this chapter, and by reason of that violationinflicts physical injury upon a child, shall upon conviction of the violationbe fined a sum not exceeding five hundred dollars ($500) and/or imprisoned fora term not exceeding six (6) months. However, if the service provider isexonerated, all costs incurred in defense of these charges shall be paid by thecovered facility.

   (c) Nothing contained in this chapter shall be construed tolimit or restrict any criminal or civil action available to an appropriateparty under applicable state law.
