§ 45-16-4.5 - Immunity.

SECTION 45-16-4.5

   § 45-16-4.5  Immunity. – No constable, while serving or executing any process or writ issued by orreturnable to the supreme, superior, family, or district court, is liable inany civil action to respond in damages as a result of his or her acts ofcommission or omission arising directly out of his or her negligent serving orexecuting the process or writ. In the event a civil action is brought against aconstable as the result of the performance of his or her duties, the constableis entitled to recover all costs and attorney's fees incurred by the constableincidental to the civil action.
