§ 45-33-12 - Remedies of obligees.

SECTION 45-33-12

   § 45-33-12  Remedies of obligees. –An obligee of an agency has the right, in addition to all other rights whichmay be conferred on the obligee, subject only to any contractual restrictionsbinding upon the obligee:

   (1) By mandamus, suit, action, or proceeding at law or inequity, to compel the agency and its members, officers, agents, or employees toperform each and every term, provision, and covenant contained in any contractof the agency with or for the benefit of the obligee, and to require thecarrying out of any or all covenants and agreements of the agency and thefulfillment of all duties imposed upon the agency by chapters 31 – 33 ofthis title.

   (2) By suit, action, or proceeding in equity, to enjoin anyacts or things which may be unlawful, or the violation of any of the rights ofan obligee of the agency.
