SECTION 45-55-8

   § 45-55-8  Sole source procurement andemergency procurements. – (a) A contract may be awarded for a supply, service, or construction itemwithout competition when, under published regulations, the purchasing officerdetermines, in writing, that there is only one source for the required supply,service, or construction item.

   (b) Notwithstanding any other provision of this chapter, thepurchasing agent may make or authorize others to make emergency procurementswhen there exists a threat to public health, welfare, or safety under emergencyconditions as defined in regulations or where the procurement will be in thebest interest of the city as established by properly promulgated rules andregulations; provided, that emergency procurements shall be made with as muchcompetition as is practicable under the circumstances. A written determinationof the basis for the emergency, and for the selection of the particularcontractor, shall be included in the contract file.
