SECTION 46-18-12

   § 46-18-12  Cessation of yearly damagesafter removal of dam. – Whenever any plaintiff shall elect to receive the yearly damages awarded him orher as aforesaid, and the millowner shall afterwards remove the mattercomplained of in the action for which the damages were awarded, the plaintiffor the plaintiff's assigns shall recover the damages for five (5) years afterthe matter shall be removed and no longer.
