SECTION 5-40.1-4

   § 5-40.1-4  Board of occupational therapy– Practice – Creation – Composition – Appointment and termof members – Meetings – Vacancies. – (a) There is created within the division of professional regulation in thedepartment of health a board of occupational therapy practice. The board shallconsist of five (5) members appointed by the director of the department ofhealth with the approval of the governor. Three (3) members shall be licensedoccupational therapists; one member shall be a physician licensed to practicemedicine in this state; and one member shall be a consumer.

   (b) The director of the department of health, with theapproval of the governor, within sixty (60) days following May 11, 1984, shallappoint one board member for a term of one year; two (2) for a term of two (2)years; and two (2) for a term of three (3) years. Appointments made thereaftershall be for three (3) year terms, but no person shall be appointed to servemore than two (2) consecutive terms. Terms shall begin on the first day of thecalendar year and end on the last day of the calendar year or until successorsare appointed, except for the first appointed members who shall serve throughthe last calendar day of the year in which they are appointed, beforecommencing the terms prescribed by this section.

   (c) The board shall meet during the first month of eachcalendar year to select a chairperson and for other purposes. At least oneadditional meeting shall be held before the end of each calendar year. Othermeetings may be convened at the call of the chairperson, the administrator ofprofessional regulation, or upon the written request of any two (2) boardmembers. A majority of the members of the board constitutes a quorum for allpurposes.

   (d) In the event of a vacancy in one of the positions, thedirector of the department of health, with the approval of the governor, mayappoint a person to fill the unexpired term.
