§ 5-48-10 - Persons and practices exempted.

SECTION 5-48-10

   § 5-48-10  Persons and practices exempted.– The provisions of this chapter do not apply to:

   (1) A qualified person licensed, registered, certified, orcredentialed in this state under any other law who is practicing the professionor business for which he or she is licensed, registered, certified, orcredentialed, in the setting for which the licensure, registration,certification, or credential pertains and performs services within theirauthorized scope of practice.

   (2) This chapter specifically excludes those persons whocommercially fit and sell hearing aids; provided, that those persons do notreceive a separate and/or additional fee for testing or interpreting tests ofhearing; and provided, that those persons do not represent themselves asaudiologists as defined in this chapter. This subdivision does not precluderemuneration for any other service offered solely in conjunction with thefitting or maintaining of a hearing aid.

   (3) No one shall be exempt under subdivision (1) of thissection for that portion of his or her time spent as a private practitioner. Ifhe or she performs any work as a speech language pathologist or audiologist forwhich a fee may be paid by the recipient of the service as part of a privatepractice apart from his or her position with the government, a license must beheld.
