SECTION 5-81-2

   § 5-81-2  Definitions. – The following words and phrases when used in this act shall have the meaningsgiven to them in this chapter unless the context clearly indicates otherwise:

   (1) "Performing group" means a vocal or instrumental groupseeking to use the name of another group that has previously released acommercial sound recording under that name.

   (2) "Recording group" means a vocal or instrumental group atleast one of whose members has previously released a commercial sound recordingunder that group's name and in which the member or members have a legal rightby virtue of use or operation under the group name without having abandoned thename or affiliation with the group.

   (3) "Sound recording" means a work that results from thefixation on a material object of a series of musical, spoken or other soundsregardless of the nature of the material object, such as a disk, tape or otherphono-record, in which the sounds are embodied.
