   § 9-1-53  Misclassification of employees– Civil action. – Any person, firm, or corporation which suffers damages as a result of acompetitive bid for a contract not being accepted due to another person, firm,or corporation knowingly misclassifying employees as independent subcontractorsmay bring an action for damages in the appropriate district or superior court.For the purposes of an action brought pursuant to this section, employee statusshall be determined by the applicable provisions of the Internal Revenue Codeof 1986, or any subsequent corresponding Internal Revenue Code of the UnitedStates, as from time to time amended.
