SECTION 9-22-12

   § 9-22-12  Discharge or discontinuance asto codefendant. – Whenever several persons shall be made defendants in any action and the actionshall be discontinued as to any one or more of the defendants, or if, upon thetrial thereof, any one or more of them shall be acquitted by verdict or uponmotion, every defendant so discharged or acquitted shall have and recover hisor her costs.
