Section 34A-1-26 - Pre-existing uses considered in ruling on variance.

34A-1-26. Pre-existing uses considered in ruling on variance. In determining whether or not a variance shall be granted by the board it shall take into consideration whether or not the facility was in existence on July 1, 1970, and if such facility was constructed after July 1, 1970, whether or not such facility was in compliance at the time of its construction.
