40-5-5. Liability for damages caused by unlawful transportation or trailing of infected animals. If any person transports, drives, or trails any animal within this state in violation of the provisions of §§ 40-5-2 to 40-5-4, inclusive, or of any order or rule of the State Animal Industry Board, he is liable for all damages sustained on account of any disease communicated by, traceable to, or resulting from such act.
