Section 40-7-33 - Maximum indemnity for cattle slaughtered--Computation based on appraised value--Restriction to amount in fund.

40-7-33. Maximum indemnity for cattle slaughtered--Computation based on appraised value--Restriction to amount in fund. The amount of indemnity paid by the state under § 40-7-30 may not exceed one-third of the difference between the appraised value of such cattle or bison and the net value of the salvage thereof and may not exceed twenty-five dollars in the case of grade cattle or bison or fifty dollars in the case of purebred registered cattle or bison. If the federal government fails to provide an equal amount of indemnity with the state, then the owner shall be paid one-half of the difference between the appraised value of such cattle or bison and the net value of the salvage thereof which may not exceed twenty-five dollars in the case of grade cattle or bison. The State of South Dakota is not liable for any indemnity if the special livestock disease indemnity fund has been exhausted.
