46A-4-58. Land not included in irrigation district unless owner or lessee obligated to pay assessments or charges. No provision of this chapter may authorize or empower the board of directors to include any land within its district unless the owner or lessee thereof shall pay or obligate the land to pay the same assessments or charges as all other lands have originally paid or have been obligated for. This shall include the cost of studies, construction, operation, and maintenance charges and the cost of water deliveries.
