58-17C-12. Factors to be considered in determining network adequacy. In determining whether a health carrier has complied with any network adequacy provision of §§ 58-17C-7 to 58-17C-26, inclusive, the director shall give due consideration to the relative availability of healthcare providers in the service area and to the willingness of providers to join a network.
