58-17C-19. Director authorized to promulgate rules--Scope of rules. The director may, after consultation with the secretary, promulgate pursuant to chapter 1-26 reasonable rules to protect the public in its purchase of network health insurance products, achieve the goals of §§ 58-17C-7 to 58-17C-26, inclusive, by ensuring adequate networks and by assuring quality of health care to the public that purchases network products. The rules may include:
(1) Definition of terms;
(2) Provider/covered person ratios;
(3) Geographic access requirements;
(4) Accessibility of care;
(5) Contents of reports and filings;
(6) Notification requirements;
(7) Selection criteria;
(8) Recordkeeping;
(9) Setting of quality criteria based upon type of network; and
(10) Quality assurance/quality improvement plans.
