9-45-35. Assumption by municipality of cost of repairing street previously constructed by assessment. In the resolution of necessity it may be provided that the municipality will pay any portion or all of the cost of resurfacing, rebuilding, or repaving the portion of any street, alley, or public way in which pavement has previously been placed and paid for wholly or in part by assessment of benefited property.
