9-47-16. Assessment of property benefited for proportionate share of original cost of pipes or mains. Whenever water pipes or mains as classified by § 9-47-8 have been constructed for which the cost has not been apportioned against property which may be benefited, as provided by §§ 9-47-5 to 9-47-15, inclusive, chapter 9-43 or chapter 9-49, the governing body may require such property to pay its proportionate share of the cost of such construction, without interest, according to the benefits to accrue to such property before such property shall be served with such facilities. The governing body shall make such investigation as necessary and shall find and determine the amount to be paid, which amount so paid shall be apportioned by the governing body as it determines among the persons, including the municipality, paying the original cost.
