12-3-133. Written acquisition plan for purchases of goods and services.
(a) Before July 1, 1997, and before July 1 each year thereafter, each department and agency of state government shall compile and submit to the commissioner of general services, a written acquisition plan for the upcoming fiscal year forecasting the specific categories and quantities of goods and services anticipated for purchase by the department or agency. The commissioner shall develop procedures to ensure uniformity among the various departments and agencies both in the manner of calculating such forecasts and in the style and format used for submitting such written acquisition plans to the commissioner. The information contained within such forecasts shall be based on good faith estimates and shall not be construed in any way to legally bind or authorize the department or agency to make any purchase in conflict with the other requirements of this chapter.
(b) Before July 1, 1997, and before July 1 each year thereafter, the commissioner shall collect, compile and publish the written acquisition plans submitted by the various departments and agencies pursuant to subsection (a), within an annual report which shall be entitled The Forecast of Acquisition Plans for State Departments and Agencies for Fiscal Year _________ _________ . A copy of the report shall be provided to the state library, to each public library within the state, and to each minority business development center. Additional copies of the report shall be available for purchase.
(c) The provisions of subsection (a) shall not apply to those entities which are exempted from the provisions of this chapter pursuant to § 12-3-103.
