47-26-805. Action on applications Rulemaking.
(a) (1) The commissioner shall adopt and establish rules and regulations for determining the qualifications of applicants for license as certified public weigher and to otherwise enforce the provisions of this part.
(2) All rules and regulations under this part shall be promulgated by the commissioner, pursuant to the provisions of the Uniform Administrative Procedures Act, compiled in title 4, chapter 5.
(b) The commissioner may pass upon the qualifications of the applicant upon the basis of the information supplied in the application, or the commissioner may examine such applicant orally or in writing, or both, for the purpose of determining the applicant's qualifications.
(c) The commissioner shall keep a record of all such applications and of all licenses issued thereon.
