49-6-6002. Tests not to be conducted earlier than grade three (3) Test dates.

(a)  No state-mandated test shall be conducted earlier than grade three (3), except that when the first and second grade tests provided for in Acts 1997, ch. 434, § 7 are available, these tests shall be conducted.

(b)  The commissioner of education is directed to establish yearly dates for the administration of the grades three through eight (3-8) achievement tests that provide the maximum instructional days possible prior to testing while maintaining compliance with all relevant federal law.
