55-51-104. Motorcycle rider safety fund.

(a)  The motorcycle rider safety fund is established in the state treasury and, subject to the provisions of the general appropriations act, shall be available on a continual basis to the department which shall administer the moneys. Moneys from the fund made available to the department shall only be used for administration of the motorcycle rider education program and for expenses relating to the program including, but not limited to, instructor training, licensing improvement, alcohol and drug education, public awareness, a driver improvement program for motorcyclists, technical assistance, program promotion, and other motorcycle safety programs. Funds may also be used for reimbursement of organizations with course sites. The department shall establish standards for disbursements of funds.

(b)  Two dollars ($2.00) of the annual registration fee for each registered motorcycle shall be credited to the fund as established in subsection (a).

(c)  One dollar ($1.00) of the application fee for a motorcycle operator learner's permit shall be credited to the fund as established in subsection (a).

(d)  One dollar ($1.00) of the fee for each original motorcycle operator's license or endorsement and for each renewal shall be credited to the fund as established in subsection (a).
