56-54-104 - Applicability of chapter.
56-54-104. Applicability of chapter.
This chapter shall apply to all medical malpractice claims in this state, regardless of whether or how they are covered by medical professional liability insurance. This chapter shall not apply to the state or those employed by the state to the extent that their medical malpractice liability is not covered by an insurance entity.
