8-30-323. Maintenance of reemployment lists.

The commissioner shall establish and maintain divisional reemployment lists and service-wide reemployment lists, which shall contain the names of persons who have been regular employees and who were separated from their positions for reasons other than fault or delinquency on their parts. The order in which names shall be placed on a reemployment list shall be established by the rules and shall not remain in force for more than three (3) years. The commissioner may strike the name of a person from a reemployment list or refuse to certify the person's name for a position if the commissioner finds, after giving the person notice and an opportunity to be heard, that such person is not qualified to perform satisfactorily the necessary duties.
